Terms and Conditions & Privacy Policy
QUOTATION AND ORDERS:
Unless otherwise specified, quote is valid for 30 days from the date of quotation and may be subject to re-quotation thereafter.
All works included in the quotation is based on the information supplied by the Customer and is subject to change if additional work is required or unforeseen problems arise.
Unless otherwise agreed, all works are to be carried out during normal business hours.
Gift, import and any other taxes, duties and charges (if any) included in the quotation are based on rates at the time of quotation. Any variations in the rates of such taxes, duties and charges as a result of the amendment or interpretation of the relevant Acts, Regulations, By-laws or Classifications shall be passed on to the Customer.
TERMS OF PAYMENT
For non-account Customers, payment for Goods and Services is due on completion of works.
For all credit account Customers, a Purchase Order is required and payment for Goods and Services is to be made in full by the 20th of the month following the date of invoice.
Integrity Security LTD reserves the right to charge a surcharge for payments by credit or debit cards.
Integrity Security LTD reserves the right to charge interest on all overdue payments at a rate of 10% for the period which the payment is overdue.
Any charges relating to debt recovery will be met by the Customer.
DELIVERY
Every effort is made by Integrity Security LTD to obtain and/or deliver Goods in advance of project commencement. In the unlikely event of late delivery or delay, the Customer accepts that no claim shall be made against Integrity Security LTD, and that late delivery or delay does not constitute a breach of contract by Integrity Security LTD.
OWNERSHIP
Legal ownership of the Goods supplied shall remain with Integrity Security LTD (who reserve the right to repossess and dispose of the Goods) until payment is received in full.
In the event of default by the Customer, Integrity Security LTD may, without giving notice and without prejudice to any of its other rights, resume possession of any Goods which remain its property. And may enter the Customer’s property, without liability for trespassing or for any resulting damage to recover the Goods. The Customer indemnifies Integrity Security LTD from and against all costs, claims, demands and action by any party arising from such action.
RISK AND INSURANCE
The risk in the Goods will pass to the Customer immediately upon delivery. The Customer shall insure and keep insured the Goods until such time as the Goods have been paid for in full.
WARRANTIES
Where products have a third-party warranty, Integrity Security LTD will (to the extent permitted by the third-party) allow the Customer to benefit from that warranty but will not itself be liable under that warranty.
In the event of a fault in a product supplied by Integrity Security LTD, we will provide free service and repair during the manufacturer’s warranty period, provided the defect is covered by the terms of the manufacturer’s warranty.
We do not, however, warrant product failure occurring due to lack of maintenance on the Customer’s behalf, or for any reasons attributable to environmental and/or joinery factors beyond our control (this includes but is not limited to door and/or window frames in either wood, aluminium or a combination of both moving or dropping), and normal charges apply in these instances.
Integrity Security LTD warrants all workmanship in the completion of Services, and installation of products supplied by us, under normal conditions of use, wear and tear for the lifetime of the product. This warranty is limited to the repair or replacement of any defective workmanship or to the value of the work, whichever is the lesser and excludes consequential loss, per our liability section.
Where Goods are supplied by the Customer, Integrity Security LTD does not warrant the workmanship supplied. Hardware warranties do not apply to Goods supplied by the Customer.
The Customer shall notify Integrity Security LTD in writing immediately they become aware and within a maximum of 6 months of becoming aware of any defects in the Goods or workmanship and shall give Integrity Security LTD every opportunity to inspect and remedy any defect.
CUSTOMER GUARANTEES ACT 1993
If the Customer is acquiring Goods or Services for the purposes of a trade or business, the Customer acknowledges that the provisions of the Consumer Guarantees Act 1993 do not apply to the supply of Goods or Services by Integrity Security LTD to the Customer. This condition in no way purports to limit any provision of the Consumer Guarantees Act 1993, or any other Act or law, when supplying Goods or Services to an individual.
LIMITATION OF LIABILITY
Integrity Security LTD may provide advice or make product recommendations as part of a security assessment, during discussions with a customer or a site visit. The Customer accepts that any such advice and/or recommendations are freely given and are based on our knowledge and experience at the time.
It is the Customer's responsibility to ascertain product suitability for their own needs.
Integrity Security LTD will not be liable for any damage, loss or expense including and without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from advice given and/or Goods or Services supplied.
Where Integrity Security LTD is liable to the Customer, the maximum cost of any liability shall not exceed the value of the Goods or Services provided by Integrity Security LTD to the Customer.
In the event of a force majeure event beyond our reasonable control, Integrity Security LTD shall be entitled to cancel or defer delivery of Goods or Services without liability.
PRIVACY POLICY
Integrity Security LTD complies with the Privacy ACT 1993 and is bound by the New Zealand Privacy Principles dealing with the collection, use and storage of personal information about individuals and will only use personal information for the purpose for which is provided.
JURISDICTION
These terms and conditions are governed by the laws of New Zealand and any dispute arising hereunder shall be subject to the exclusive jurisdiction of the courts in New Zealand.
